Austria Student Residence Permit in 2026

Third-country nationals who will study in Austria for the relevant duration generally use the Residence Permit – Student rather than an employment RWR Card. Study remains the primary purpose of stay.

Who this route is for

  • Hold admission/enrolment appropriate to the Student residence category and provide the required study documentation.
  • Show adequate means of subsistence. Austria’s current official pages are inconsistent for applicants below age 24: the English migration portal lists €777.58 per month, while the German temporary-residence page lists €722.58 per month. Both show €1,308.39 per month for older students. Because the federal pages conflict, confirm the amount the competent residence authority will apply before filing; accommodation costs also affect the calculation.
  • Maintain health insurance covering Austria and satisfy the other residence requirements.
  • For extensions, provide evidence of required study progress.

2026 requirements that matter

A third-country student does not receive unrestricted employment merely from the residence permit. The official migration guidance says an employer may obtain an AMS employment permit for up to 20 hours per week without a labour-market test, provided the work does not undermine the primary study purpose.

Austria’s general residence framework also requires attention to identity documents, health insurance and any route-specific accommodation or subsistence rules. The Federal Ministry of the Interior publishes 2026 general reference rates of €1,308.39 for a single person, €2,064.12 for a married/registered couple and €201.88 for each child, but it also states that proof of those general subsistence amounts is not required in the same way for the Red-White-Red Card and EU Blue Card. Route-specific pay or capital rules must therefore be kept separate from the general reference rates.

How the application works

Initial applications are handled through the competent residence/consular process depending on nationality and circumstances. Applicants should not assume that lodging in Austria extends a visa-free or visa-authorized stay beyond its lawful end date.

Foreign documents may need translations and, depending on the document and authority, legalized versions. Many first residence applications also require a recent criminal-record extract. Requirements can vary by the applicant’s nationality, lawful location and the competent provincial residence authority.

Validity, work rights and transition

After successful qualifying Austrian study, a graduate can make a one-time 12-month extension of Student residence to search for work or start a business and, with a qualifying offer, may transition to the dedicated graduate RWR Card. The graduate route is a separate authorization, not an automatic conversion.

Long-term residence must be calculated separately from student status. Austria’s federal guidance states that time spent on a temporary stay permit such as Residence Permit – Student can be counted only at half toward the five-year Long-term Resident – EU period when the applicant is currently entitled to settlement. Five years on a student permit should therefore not be described as five full years of qualifying settlement.

Fees and processing time

Official Austrian pages publish application fees by title and visa. Where this guide quotes a figure, it is the amount shown by the competent federal portal for 2026. Additional document, translation, legalization, Visa D or local administrative costs can arise. Austria does not publish one guaranteed processing time that applies to every applicant in this route; completeness, AMS review where required, provincial authority workload and requests for additional evidence can affect timing.

Common mistakes

The under-24 and over-24 figures are student subsistence benchmarks, not salaries. Work up to 20 hours per week still requires the employer to obtain the AMS employment permit.

A residence title also does not settle tax residence. Austria’s Federal Ministry of Finance applies tax rules based on residence/domicile and habitual presence; after six months of stay, unlimited Austrian tax liability arises in any event with retroactive effect, while a home available for recurring use can create tax consequences earlier.
