Benin Entrepreneur and Self-Employment Guide in 2026
Benin does not currently publish a standalone national startup visa, unrestricted freelancer visa or generic entrepreneur residence visa. A foreign founder normally has to combine the corporate/business formalities with the immigration category that matches the actual activity and length of stay.
That separation is the most important planning point: forming a company in Benin is not itself permission to reside or work indefinitely in Benin.
The practical founder stack
A founder's route can involve several independent layers:
- Company or individual-business registration through APIEx/MonEntreprise when a local legal presence is needed.
- The appropriate entry/stay visa, such as the Business Visa for economic/commercial/industrial activity or the Professional Visa for qualifying professional activity.
- A Resident Card if the founder is actually establishing long-term residence.
- Tax, employer, social-security, licensing and sector-specific registrations triggered by the actual business.
- For a qualifying foreign investor/operator inside Glo-Djigbé ZES, the distinct ZES Investor Resident Card.
Company registration through APIEx
The official MonEntreprise platform currently lists the following creation charges and targets after a complete submission:
- Individual establishment: 10,000 FCFA; stated processing target 3 working hours; no minimum capital shown.
- SARL / SUARL: 22,000 FCFA; capital freely set; stated processing target 3 working hours.
- SA: 37,000 FCFA; official comparison page lists a 10,000,000 FCFA minimum capital with half at formation.
- SAS: 37,000 FCFA; capital freely set on the official comparison page.
The platform also covers other company forms and branches.
Those are company-registration figures, not visa or residence fees.
Documents for a foreign individual business owner
MonEntreprise's current required-document page lists, for a foreign individual establishing a business, items including:
- valid passport;
- criminal record less than three months old or the published sworn-declaration alternative;
- recent identity photo; and
- for foreigners, a consular card, residence permit, eVisa or resident card as applicable.
Company-form documents differ by legal form and can include signed statutes, identity documents for shareholders/managers, manager criminal record, registered-office evidence, and capital/subscription documentation for certain companies.
Which visa should a founder use?
Business visa
Use the Business Visa guide where the purpose fits economic, commercial or industrial activity. The current decree gives the visa a two-year validity with stays up to 90 days per entry.
Professional visa
A founder or independent specialist whose activity is properly characterized as professional should compare the Professional Visa, valid for up to 12 months and renewable.
Resident card
If the founder is moving to Benin as a place of long-term residence rather than making business visits, the Resident Card guide is the more relevant framework. A functional business can become one of the durable ties relevant to privileged-resident progression, but the applicant normally has to satisfy the ordinary-resident progression first.
Does Benin have a startup visa?
No current official visa in Decree 2026-049 is named a startup visa. The legal categories are based on the purpose of stay—business, professional, and so on—not whether the company calls itself a startup.
A founder should not pay for a supposed “Benin startup visa” without identifying the official underlying status.
Freelancers and self-employed professionals
There is likewise no open immigration status named “freelancer visa.” An independent professional may fit the professional visa, a locally established business may require APIEx registration, and a long-term resident needs the relevant residence authorization.
The labour Work Permit is aimed at foreign salaried employment, so it should not automatically be applied to every self-employed founder.
Hiring employees
Once the business becomes an employer, company registration is only the beginning. Employer/social-security and labour registrations can apply. When hiring a foreign salaried worker, the labour work-permit rules become relevant.
Investment versus residence
Ordinary company capital does not create a general passive residence-by-investment right. Benin's expressly published investor-linked immigration product is the special five-year resident card for foreign investors/operators in the Glo-Djigbé Special Economic Zone. That route should not be generalized to a founder outside the ZES.
Tax considerations
A company or individual business can trigger Beninese tax obligations independently of the founder's immigration label. Assess entity registration, tax identification, corporate or business taxation, VAT/withholding where relevant, payroll, permanent-establishment issues and treaty rules with current DGI guidance.
Long-term residence and nationality
A founder who becomes an ordinary resident can later consider privileged residence if the statutory progression and durable-tie conditions are met. Creation of a functional business/industrial/commercial establishment is one factor expressly identified for privileged-resident eligibility after the required ordinary-resident renewals.
Naturalisation is separate and generally requires five years of principal residence before application plus the nationality code's other conditions; company formation does not waive those conditions.
