E-2 treaty investor in 2026

E-2 is a nonimmigrant classification for qualifying treaty-country nationals who invest substantial capital in a real U.S. enterprise and come to develop and direct that enterprise.

Treaty nationality comes first

The principal investor must be a national of an E-2 treaty country. The Department of State maintains the treaty-country list. Special rules can apply where nationality was acquired through financial investment, so applicants should check the current statutory and consular requirements.

No universal fixed dollar minimum

U.S. law does not publish one fixed E-2 investment threshold that applies to every business. The capital must be substantial relative to the cost and nature of the enterprise, committed and at risk, and sufficient to support the investor's financial commitment to the business.

Money sitting uncommitted in a bank account is not enough.

Real operating business and control

The enterprise must be bona fide: a real, active and operating commercial undertaking. The investor must normally show at least 50% ownership or operational control sufficient to develop and direct the enterprise.

The business cannot be structured merely to support the investor and family at a marginal level under the applicable rules.

Temporary status, not EB-5

E-2 is not a green-card category. It is legally distinct from EB-5, which is an immigrant investor program.

Eligible spouses and children can qualify for derivative E status; spouse work authorization is governed by current status-documentation rules.
