Peru Worker Residence in 2026

Peru's Trabajador residente category is the main residence route for a foreign national who will perform paid activity under a qualifying work or services relationship in Peru. The Migration Law covers both subordinate and independent lucrative activity for the public or private sector.

Who the route is for

Migraciones' current initial application procedure describes applicants with:

  • an employment contract;
  • an administrative relationship; or
  • a contract for the provision of services in Peru.

That makes the route relevant not only to conventional employees but also to some independent professionals with a qualifying Peru-side services contract. It is not, however, a generic “freelancer visa” with no contractual basis.

The Migration Law also includes certain employees of transnational or international corporations moving to Peru to work within the same economic group as senior management, trusted staff or specialist personnel. A foreign-employer assignment may alternatively fall under the distinct Designado category depending on how the work is structured.

Contract duration and temporary-worker cases

For the initial worker-resident procedure, Migraciones asks for an employment contract whose term is at least one year, approved by the labor authority unless a legal exception applies. The document must also satisfy the published recency conditions.

Migraciones says that when the contract contains a probationary period or has a term of less than one year, the application is evaluated under the temporary worker procedure instead. That distinction can materially affect which application is correct.

For a Peru contract signed while the foreign national is in the country, the person must have immigration status that permits the signature or a separate authorization to sign documents.

Initial application

The published resident procedure requires the applicant to be outside Peru to obtain the immigration category. Core requirements include a current passport, criminal/police/judicial background evidence for the relevant prior five-year period, and the qualifying contract and employer documentation.

The contracting company must be active and in good standing before SUNAT. Additional labor-law rules apply to foreign-worker contracts, so an immigration filing does not replace employer compliance.

Fee and processing period

On the official procedure page checked 7 October 2026, Migraciones publishes a government fee of S/58.80 and a maximum response period of 30 calendar days. Fees and administrative codes can change, so verify the live government page immediately before payment.

Residence term and extension

The law sets Worker residence at 365 days. Migraciones' 2026 extension guidance says the residence extension is generally for 365 days and can be extended for the same period, with the extension procedure filed before expiry.

Do not confuse residence validity with the validity printed on a Carné de Extranjería. Migraciones has expressly clarified that the card and the underlying immigration residence can have different validity periods.

Remote workers and local clients

Worker Residence should not be used as an improvised version of Peru's Digital Nomad Status. The worker route is tied to the Peruvian work/services relationship described in the official procedure, while the statutory digital-nomad category is drafted around foreign-employer remote employment and remains without a current application procedure found by ReloTide.

Independent professionals should also analyze Peruvian tax registration, invoicing, regulated-profession and social-security obligations separately from the immigration permission.

Long-term route

Workers who meet the applicable residence history can compare Permanent Residence. Migraciones' general permanent-residence procedure currently uses three consecutive years for worker residents, subject to its other conditions and absence rules.
